Missed July 31 ITR Deadline? Know the Consequences of Late Filing

If you missed the July 31, 2026 deadline for filing your income tax return for FY 2025-26, you can still file a belated return. However, late filing may result in additional fees, interest, or other applicable consequences.

Individuals who are not engaged in a business or profession that requires a tax audit generally do not need to have their accounts audited. This includes salaried employees, pensioners, and individuals earning only salary or other non-business income. Such taxpayers were required to file their income tax returns (ITRs) by July 31, 2026, subject to applicable conditions. Taxpayers with unaudited business or professional income can file their Income Tax Returns (ITR) by August 31, 2026.

Key Consequences of Late Income Tax Return Filing Explained

Salaried taxpayers who miss the ITR filing deadline may be required to pay a late filing fee and interest on any unpaid tax liability.


Taxpayers who file their Income Tax Return (ITR) after the due date are liable to pay a mandatory late filing fee under Section 234F. According to Neeraj Agarwala, Senior Partner at Nangia & Co., the fee is limited to ₹1,000 for taxpayers with total income up to ₹5 lakh and ₹5,000 for those whose total income exceeds ₹5 lakh.


Salaried taxpayers with outstanding self-assessment tax liabilities incur mandatory interest under Section 234A at 1% per month (or part of a month). This interest applies from the day immediately following the statutory filing due date until the actual date of return submission or tax clearance, whichever is earlier.


"Depending on the taxpayer's circumstances, interest under Sections 234B and 234C may also apply. Use the interest calculator on the income tax department's efiling portal to calculate the applicable interest," says Agarwala.


Losses That Cannot Be Carried Forward

Taxpayers carrying business or capital losses must file their Income Tax Return (ITR) on or before the statutory due date under Section 139(1) of the Income Tax Act. Missing this deadline forfeits the right to carry forward these losses to offset taxable income in subsequent assessment years (except house property loss).


According to Agarwala, if a taxpayer files the income tax return after the due date, certain losses generally cannot be carried forward and set off against income in subsequent years.


However, taxpayers may still be allowed to carry forward certain losses, such as unabsorbed depreciation, subject to the applicable provisions of the Income-tax Act.


ITR Refund May Be Delayed

A tax refund becomes payable only after the taxpayer files a valid Income Tax Return (ITR) and the Income Tax Department processes the return. Delayed filing may therefore result in a delay in receiving the refund.


Submitting a belated Income Tax Return (ITR) does not invalidate an eligible refund claim, but it can significantly extend processing timelines. According to Vishwas Panjiar, Managing Partner at SVAS Business Advisors, delays are further compounded if the return is flagged for scrutiny under automated risk management or contains data discrepancies requiring taxpayer clarification.


For Income Tax Returns (ITR) filed on or before the statutory due date, the Income Tax Department computes interest on eligible refunds from 1st April of the relevant Assessment Year up to the date the refund is granted. However, filing a belated return directly impacts this timeframe, reducing the total period for which statutory refund interest under Section 244A is payable.


If an individual files the Income Tax Return (ITR) after the due date, interest is generally calculated from the date of filing the return, which may reduce the overall interest amount.


Any delay in issuing the refund attributable to the taxpayer may also be excluded when calculating the interest payable, according to Panjiar.
